Terms of Service

Acceptance of Terms
By creating an account or using Sparkfield (“the Service”), you agree to these Terms of Service. If you are a teacher, school, or administrator using Sparkfield on behalf of students, you represent that you have the authority to agree to these terms on behalf of your institution and that your use complies with applicable laws, including FERPA and COPPA.
Who Can Use Sparkfield
- Teachers and administrators may create accounts directly at sparkfield.app.
- Students may only join Sparkfield through a class join code provided by their teacher. Students do not independently create accounts.
- Parents may create read-only portal accounts when invited by a teacher.
Teacher Responsibilities
Teachers who use Sparkfield with students are responsible for:
- Obtaining any necessary parental consent required by their school or district before enrolling students under 13
- Ensuring student account information (names, grades) is accurate and appropriate
- Supervising student use of the platform in accordance with school policies
- Promptly removing students who should no longer have access
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any school, district, or applicable law
- Attempt to access other users' accounts or data without authorization
- Reverse-engineer, scrape, or copy the Service or its content
- Upload content that is abusive, illegal, or inappropriate for a K–8 school environment
Intellectual Property
All content, design, and software comprising Sparkfield is owned by or licensed to Sparkfield and protected by copyright. Teachers retain ownership of challenges and materials they create on the platform. Student work (essays, responses) belongs to the student and their family.
Subscriptions & Billing
Sparkfield offers a free tier and a paid Pro plan. Paid subscriptions are billed monthly or annually through Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods except where required by law.
Disclaimer & Limitation of Liability
Sparkfield is provided “as is.” We make no warranties regarding uninterrupted availability or error-free operation. AI-generated content (essay grading, challenge generation) is provided as a tool to support — not replace — teacher judgment. Teachers should review AI-generated grades and content before acting on them.
To the fullest extent permitted by law, Sparkfield's liability for any claim arising out of use of the Service is limited to the amount you paid us in the three months preceding the claim.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York.
Changes to These Terms
We may update these terms from time to time. We will notify registered teachers by email if changes are material. Continued use of the Service after changes constitutes acceptance.
